These Terms and Conditions ("Terms") govern your access to and use of the mobile game ("Game") provided by Playback Games ("Company", "we", "us", or "our"). By accessing or using the Game, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Game.

1. License

3. In-App Purchases

3.1. The Game may include optional in-app purchases. You agree to pay all fees and applicable taxes incurred in connection with your purchases.

3.2. All purchases are final and non-refundable, except as required by applicable law.

4. User Conduct

4.1. You agree not to:

• Use the Game for any unlawful purpose or in violation of any applicable laws or regulations.
• Interfere with or disrupt the Game or servers or networks connected to the Game.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorised access to any portion of the Game.

5. Intellectual Property

5.1. The Game and all content and materials contained therein, including but not limited to text, graphics, logos, images, and software, are owned or licensed by us and are protected by copyright, trademark, and other intellectual property laws.

5.2. You may not modify, reproduce, distribute, transmit, display, perform, or create derivative works of the Game except as expressly authorised by us.

6. Disclaimer of Warranties

6.1. THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

7.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAME.

8. Indemnification

8.1. You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Game or your breach of these Terms.

9. Modifications to Terms

9.1. We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10. Governing Law

10.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

11. Dispute Resolution

11.1. Any dispute arising out of or relating to these Terms or your use of the Game shall be resolved exclusively through arbitration administered by the London Court of International Arbitration (LCIA) in accordance with its Arbitration Rules.

13. External Servers

13.1. The application connects to several external servers during play:

• d2.touchdowners2.com: This server handles the communication with the game's server, including accessing and modifying the user's profile, accessing information about other profiles for matchmaking and leaderboard purposes, and handling rewards. It also serves the purpose of monitoring the user's connection with the internet during gameplay.
• ip2c.miniclippt.com: This server uses publicly available data to find out the user's approximate geolocation by IP address. This data is used to select the default flag in the user profile upon opening the game for the first time. The exact location is not stored anywhere, and the automatically selected flag can later be changed by the user.
